1. Account Creation

Customers must provide complete, accurate and up-to-date information during registration. Account activation occurs only after successful verification and payment confirmation. Linkupnepal Hosting reserves the right to reject or suspend accounts containing false, misleading or incomplete information.

2. Payments

Customers are required to make payments on monthly, yearly or agreed billing cycles. Failure to pay invoices by the due date may result in service suspension or termination.

3. Billing & Invoicing

• All recurring services are billed in advance.
• Renewal invoices are generated at least 7 days before service expiry.
• Payment is due on the invoice due date.
• Late fee of 10% or NPR 300 (whichever is higher) may be applied.
• Services may be suspended after 1 day of non-payment.
• Hosting services may be terminated and data permanently removed after 7 days.
• Promotional pricing is non-recurring unless explicitly stated.
• Third-party fees and setup fees are non-refundable.

4. Acceptable Use Policy

• Spam or unsolicited email distribution.
• Malware, phishing or virus distribution.
• Hacking or unauthorized access attempts.
• Hosting illegal, abusive or fraudulent content.
• Copyright or trademark infringement.
• Activities that negatively impact other customers.

5. Service Uptime

Linkupnepal Hosting strives to maintain 99.9% uptime but does not guarantee uninterrupted availability. Downtime may occur due to maintenance, software updates, hardware failures, network issues or events beyond our reasonable control.

6. Data Backup

Customers are solely responsible for maintaining independent backups of all data. Linkupnepal Hosting does not guarantee backup availability, restoration or data recovery.

7. Meaning of Unlimited Services

Unlimited services are intended for normal website hosting usage and do not impose predefined limits on storage, bandwidth or websites within reasonable shared hosting usage.

8. What Unlimited Does NOT Mean

• Online file storage services.
• Backup repositories.
• Video streaming platforms.
• File sharing services.
• Torrent or peer-to-peer activities.
• IRC services.
• Testing or development environments consuming excessive resources.
• Enterprise-level workloads.

9. Storage & Database Usage

• Database usage must remain within plan limitations.
• Multiple databases are permitted.
• Excessive database usage may impact performance.
• Linkupnepal Hosting may request optimization or reduction of resource usage.

10. Unlimited File Transfer

No fixed limits are imposed on visitor traffic or monthly bandwidth usage. However, Linkupnepal Hosting reserves the right to limit usage affecting server stability.

11. Unacceptable Resource Usage

• Cron jobs more frequent than every 15 minutes.
• MySQL queries exceeding 30 seconds.
• CPU usage exceeding 25% for more than 90 seconds.
• Excessive disk I/O operations.
• Mailbox size exceeding 5GB.
• Combined mailbox storage exceeding 50GB per domain.

12. Backups

Nightly backups may be performed for administrative purposes only. Backups are not guaranteed and may not always be available for restoration. Linkupnepal Hosting accepts no liability for loss of customer data.

13. Security Measures

• Customers must use strong passwords.
• Customers must secure applications and scripts.
• Customers are responsible for credential security.
• Linkupnepal Hosting implements commercially reasonable security measures.
• Absolute security cannot be guaranteed.

14. Support Services

Technical support is provided according to the subscribed service plan. Support response times may vary depending on issue complexity and service level.

15. Service Termination

• Customers may terminate services with prior notice.
• Services may be suspended or terminated for policy violations.
• Illegal activities may result in immediate termination without notice.
• Data may be permanently removed after termination.

16. Refund Policy

• Applicable only to eligible web hosting plans.
• Refund requests must be submitted within 24 hours of purchase.
• Domain registrations are non-refundable.
• Third-party services are non-refundable.
• Promotional services are non-refundable.
• Approved refunds are processed within 7 business days.

17. Abuse Reports & Takedown Policy

Linkupnepal Hosting reserves the right to remove content or suspend services upon receipt of:

• Spam complaints.
• Malware reports.
• Phishing complaints.
• Copyright infringement notices.
• Court orders.
• Government requests.
• Security incidents.

18. Domain Registration

• Domains are subject to registry and registrar policies.
• Domain registration fees are non-refundable.
• Customers must maintain accurate WHOIS information.
• Expired domains may incur redemption fees.
• Failure to renew may result in permanent loss of the domain.

19. Limitation of Liability

Linkupnepal Hosting shall not be liable for any indirect, incidental, special, consequential or punitive damages including loss of profits, loss of revenue, loss of business or loss of data.

20. Indemnification

Customers agree to indemnify and hold harmless Linkupnepal Hosting, its employees, officers and partners from any claims, damages, losses or liabilities arising from customer use of services.

21. Force Majeure

Linkupnepal Hosting shall not be liable for service interruptions caused by natural disasters, internet outages, cyber attacks, power failures, government restrictions, labor disputes or other events beyond reasonable control.

22. Data Retention After Termination

Data may be permanently deleted after termination. Linkupnepal Hosting is under no obligation to retain customer data following service cancellation.

23. Use of Customer Name & Logo

Customers grant permission for Linkupnepal Hosting to display their name and logo for portfolio and marketing purposes unless written withdrawal is submitted.

24. Delivery of Services

Services are delivered electronically. Confirmation emails are sent upon successful payment. Any delivery delays will be communicated through email or support channels.

25. Confidentiality

Customer information shall remain confidential and will only be disclosed when required by law, court order or competent governmental authority.

26. Amendments

Linkupnepal Hosting reserves the right to amend these Terms at any time. Continued use of services constitutes acceptance of revised Terms.

27. Legal Jurisdiction

These Terms shall be governed by and interpreted under the laws of Nepal. Any disputes shall be subject to the jurisdiction of the courts of Kathmandu, Nepal.

28. Right to Refuse Service

Linkupnepal Hosting reserves the right to refuse service, suspend accounts, or terminate services at its sole discretion where continued provision of service creates legal, operational, security or reputational risk.
